The 2019 EVALI (E-cigarette or Vaping Use-Associated Lung Injury) outbreak caused severe lung injuries across the United States. The CDC's investigation identified Vitamin E acetate as the primary culprit — found in the lung fluid of patients and linked to illicit THC cartridges. The 2019 EVALI crisis established one compound as categorically unsafe for inhalation: Vitamin E acetate (tocopheryl-acetate). The CDC found it in the lung fluid of EVALI patients. It was marketed by multiple companies as a safe thickener before being identified as a lung injury agent. One manufacturer — Mr. Extractor, operating as Connoisseur Concentrates in Oregon — sold a product called Clear Cut containing Vitamin E acetate and publicly claimed it had anti-inflammatory benefits to the lungs even after the CDC findings. Yes. Terps USA, LLC is a registered Colorado business entity founded in 2019 by Kenneth Fry. Federal trademark ® held. In April 2025, a Colorado District Court jury deliberated 30 minutes and returned a complete verdict of no liability on all counts in Case No. 2023CV32008 — a lawsuit filed by competitor Anton Neznamov and Liquidizer, LLC seeking $985,000 and the company's dissolution.
